Definitions

In addition to terms defined elsewhere in these Terms of Use, the following terms shall have the following meanings in these Terms of Use, unless the context requires otherwise:

“Gilibookers.com” means Vibez Travel UK Limited, having its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ and registered with Companies House with company number 14155471;
“us”, “we”, “our”, or “Vibez Travel” means or relates to Vibez Travel UK Limited, its affiliated enterprises, and each of our and our affiliated enterprises’ respective officers, directors, shareholders, employees, sub-contractors, representatives, and assigns; and
“you”, “your” means or relates to the Users.

Access To Services

You must be at least 18 years old to use the Services. You are solely responsible for ensuring that your use of the Services is in compliance with all laws, rules, and regulations applicable to you. You may not use the Services and not accept the Terms of Use if you are a person barred from accessing the Services under the applicable laws of the country in which you are resident, or from which you interact with the Services. Each User is also responsible for ensuring that all persons who access the Services through that User’s internet connection are aware of, and comply with, these Terms of Use.

Users are responsible for making all arrangements necessary to gain access to the Services. Access to each of the Services is permitted on a temporary basis, and we reserve the right to withdraw or amend any Services we provide without notice. We will not be liable in any way if, for any reason, Services are unavailable at any time or for any period. From time to time, we may restrict access to any or all parts of the Services, at our sole and absolute discretion.

Account & Password

Vibez Travel may require you to create a User Account with us or log in using your Facebook login information to use (parts of) the Services. Vibez Travel may require you to provide a unique Username using your email address or other identifiers, a password, date of birth, title, name, address, country, telephone number, and financial information to create a User account with Us.

You must provide accurate and complete information and keep your User identification details updated. You will not use a username or the name of another person with the intent to impersonate that person. All User identification details, passwords, and other pieces of information provided as part of our security procedures must be treated as confidential and should not be disclosed to any third party. You will be solely responsible to Vibez Travel for any activities that occur under your User account, and we are not responsible for any problems with Your User account due to misuse of your identification details and/or passwords. If you become aware of or suspect any breach of the security of any portion of the Services, you agree to notify us immediately. You will not use another person’s User account or identification details to use the Services without permission.

We have the right to disable any User account or password, at any time, if in our sole and absolute opinion the User has failed to comply with any of the provisions of these Terms of Use. By using the Services through Facebook, you permit us to access information from your Facebook profile in accordance with our privacy policy. You may control the amount of information that we can access by adjusting your Facebook privacy settings. By using the Services, you are authorizing us to collect, store, retain, and use all information you permitted Facebook to provide to us in accordance with our privacy policy.

Intellectual Property Rights

“Gilibookers.com” and the “Gilibookers.com” logo, and the names, logos, taglines, and other marks identifying any Vibez Travel group companies (together, the “Trade Marks”), and all rights therein, are the property of Vibez Travel. Any other trademarks or service marks displayed on the Services are the property of their respective owners. These Terms of Use do not grant Users the right to use any Trade Mark, or any service mark or logo appearing on the Services for any purpose whatsoever.

All Content and all Trade Marks (together, the “Materials”) are, or may be, protected by law. Vibez Travel is the owner or the licensee of all intellectual property rights in the Materials. All rights in the Materials are reserved. Except as expressly set out in these Terms of Use, Users are granted no rights in the Services or any of the Materials.

Subject to these Terms of Use, each User may, for his or her personal, non-commercial use only, view, download and print one copy of any page(s) or sections from the Services for personal reference and may draw the attention of others within his or her respective organisation to any Materials posted on, or made available through, the Services.

Except as set out in these Terms of Use, none of the Materials may be copied, reproduced, republished, transferred, downloaded, modified, transmitted, displayed, sold, distributed, or licensed, by any means or otherwise exploited in any manner including, but not limited to, electronic, photocopying, mechanical, recording or otherwise, without the prior express written permission of Vibez Travel.

Partners & Affiliates

Your bookings for travel, activities, and associated services forms a contract with us, as well as a contract with the companies offering those services (each is an “Operator”), whose terms (the “Operator Terms”) are made available to you before any booking is completed, and which you also accept when a booking is made

You are responsible for familiarising yourself with the Operator Terms which apply to your booking. In the event of any conflict or inconsistency between these Booking Conditions and the Operator Terms, the Operator Terms shall prevail.

It is imperative that you understand that Vibez Travel operate this Site, and that each individual Operator is responsible for all journeys made, or activities offered when you choose to select individual services.

We reserve the right to change these Booking Conditions from time to time, but any changes will not apply to existing bookings. Please save the Booking Conditions applicable to your particular journey so that you can refer to them at a later date.

The person who makes a booking using this Site must have the authority to make any booking on behalf of any other Customer. Each person who makes a booking is responsible for his or her activities on our Site, and for safeguarding any personal information provided, including passwords, names, contact information, passport, and travel details. Any person who makes a booking on behalf of other customers must ensure that all information provided by him or her is complete and accurate.

Fares & Tariffs

Fares are calculated on the number of passengers, route(s), seating class, travel dates, and times. Your booking may require you to depart and/or return at or within specified dates and times. If you do not adhere to those specified dates and times, you may be refused travel and/or have your booking specification and accommodation changed, and/or be subject to additional charges.


In addition, any promotional rates may be lost, and full fares charged. Additional charges as contemplated in this paragraph may be debited to your credit or debit card that you used when making a booking, without further reference to you.


We have the right to vary all displayed fares, including where Operators change their fares (including, but not limited to, for reasons of currency fluctuations, fuel prices, and changes in legislation) at any such time until a booking is confirmed.

Confirmation & Payment

Each reservation is paid directly to us, in full, at the time of booking, before a confirmation is electronically provided. Payment can be made by debit or credit card, PayPal, or by any other means offered during the payment processing stage.

The contract between Us and You is formed once your booking has been completed and full payment received. We will issue a confirmation email containing your travel itinerary, QR code, and reservation number.

You agree that the data that we store in our information systems (or those of our service providers) constitutes proof of your booking and its details. If payment is made by debit or credit card the amount or balance due will be taken from that card at the time of booking.

Departure Schedules

All departure/arrival times are estimated by the Operator and are advertised in the local time zone - please refer to your booking confirmation for details. You are advised to check with the Operator for any changes prior to commencing your journey.

Boating schedules may be interrupted and/or crossing times extended or cancelled due to adverse weather conditions and/or tidal conditions and/or other circumstances.

It may be necessary to use alternative vessels or points of departure or arrival or to change/withdraw the facilities/services available for various operational, technical, or scheduling reasons.

We do not accept liability whatsoever for any costs or inconvenience caused as a result of such circumstances, but we will try to notify you, if practical, using the contact details provided by you at the time of booking. The individual Operator Terms apply to any liability of the Operator in such circumstances.

Cancellation & Amendment Policies

ACTIVITIES AND TOURS

Cancellation policies vary per activity/tour, so please check the 'Terms & Conditions' of the activity or tour you are booking on the respective activity/tour page, for the specific policy that applies to your booking.

Should the cancellation policy of the specific tour/activity you have booked allow for a refund, this will be paid directly from Gilibookers.com (minus any charges applied to make the refund); administration and cancellation charges applied to all cancellations will be equivalent to 10% of the amount being refunded.

* Should you fail to show up for a booked transport service, tour, activity, or any other booking with any of our service providers, you will be considered a “No-Show”. In such cases, where no prior notification has been given to the service provider, No-Shows will be considered cancellations for all service providers.

When notifying other service providers of a cancellation, please forward a copy of the email to bookings@gilibookers.com to help us process your refund quickly. All relevant contact information is contained in the email confirmation sent to you at the time of your booking.

FAST BOAT TRANSPORT

All fast boat bookings that are cancelled more than 2 weeks prior to the departure date will receive a full refund, paid directly from Gilibookers.com (minus any charges applied to process the refund). Cancellations made more than 48 hours, but less than 2 weeks, prior to the departure date will receive a 50% refund. Cancellations made less than 48 hours from the departure date will receive no refund.

Gilibookers.com will apply an administration charge to all cancellations and amendments equivalent to 10% of the refund amount. This cancellation policy overrides any of the fast boat companies' individual cancellation policies and all refunds will be made directly by Gilibookers.com.

No-shows will be considered cancellations for all service providers. When notifying the fast boat companies of a cancellation please forward a copy of the email to bookings@gilibookers.com to help us process your refund quickly. All relevant contact information is contained in the email confirmation sent to you at the time of your booking.

Age & Responsibility

You warrant that you are 18 years of age or over and have the legal capacity to use the Site and to create a legally binding contract.

You warrant that all personal information submitted during the booking process is correct, and you accept financial responsibility for all transactions made under your name or account.

You hereby authorise Gilibookers.com to process all Personal Information about you and the persons named on the booking that has been gathered in connection with your booking. Personal information shall be deemed to include, but not be limited to telephone numbers, fax numbers, email addresses, addresses of residences, signatures, ID or passport copies, or any other information submitted by you or on behalf of your companions.

Animals

The carriage of animals is only permitted if the Customer notifies us before making the booking. Any such carriage must be in accordance with any relevant legal requirements and the requirements of the Operator.

A charge may be made for the carriage of any animals, and further conditions may be imposed. Please seek advice from your vet or the appropriate authority before making a booking. You are legally responsible for the animals and wholly responsible for obtaining any necessary documents, consent, and permission.

Before You Travel

Gilibookers.com is not liable for any damages or losses that may result from travel to any particular destination. The Government of your country may issue advice for travellers to stay safe overseas. Check with your government for the latest advice on conditions and general information concerning specific countries.

It is your responsibility to ensure you have the relevant travel and health documents before departure for the destination you are visiting, which include, but is not limited to:

  • vaccinations that may be required,
  • insurance, and
  • visas.

Gilibookers.com shall not be liable for any expenses incurred resulting from missing, incomplete, or incorrect documentation or any non-compliance with local requirements.

Insurance

You are strongly advised to take out adequate travel insurance prior to arriving at your destination. It is your responsibility to check you have adequate insurance coverage. The insurance should cover, amongst other things, the cost of cancellation by you, personal losses, all medical costs associated with illness, accident, or injury, and the costs of assistance if required to return to your country of residence in the event of an emergency.

Force Majeure

Gilibookers.com will not be liable for any changes, cancellation, effect on your booking, loss, or damage suffered by you or for any failure by other service providers and/or Gilibookers.com to perform or properly perform any of our respective obligations to you which are due to any event(s) or circumstance(s) if the non-performance is caused by force majeure.

By way of example force majeure includes, but is not limited to war, revolution, terrorist act, closure of borders, epidemic, natural catastrophe, extreme weather conditions, or other causes that seriously affect both parties and other unforeseeable causes beyond Gilibookers.com's control.

Our Liability

We are responsible for:

  • the selection and monitoring of Operators;
  • the accuracy of any published information that we provide.

We are not responsible for any information that has not been published by us, including information published on Operator websites that we may represent.

We are not responsible for the services that you book via the Site - those remain the sole responsibility of the Operator.

Limitation of Liability

We do not limit our liability for:

  • (i) loss caused by our fraud or fraudulent misrepresentation;
  • (ii) loss arising from death or personal injury caused by our negligence; or
  • (iii) any other loss that may not be excluded or limited by applicable law.

In all other respects, we shall be liable only for losses that arise directly:

  • (a) from our breach of a legal duty of care; or
  • (b) are a result of our breach of these Booking Conditions, and that liability is at all times limited to a sum equivalent to twice the amount paid by you for a booking, in respect of the relevant Customer.

Claims against us for compensation are limited or excluded insofar as international treaties or other legal regulations that limit or exclude liability apply to the arrangements to be provided. Liability for sea transportation is governed by the applicable stipulations of international treaties including the Athens Convention. That treaty limits the liability of the Operator for shipping incidents and fault or negligence. You must notify Vibez Travel in writing of your loss within 30 days.


The courts of England and Wales will have exclusive jurisdiction over any claim arising from, or related to, these Terms of Use, the Services and/or any Materials. These Terms of Use and any dispute or claim arising out of or in connection with them, or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
